TERMS & CONDITIONS – DAFFODIL DAY PRE-ORDERS 

Quick Summary (Important) 

These Terms apply to Daffodil Day preorders. This is a campaign preorder store, not a general retail shop. In particular: 

  • Orders are pickup only — delivery is not available 

  • Pickup locations and time windows cannot be changed 

  • Flowers are perishable and may vary in appearance 

  • Refunds are limited due to campaign logistics 

  • Orders not collected during the pickup window may be forfeited 

Please read these Terms carefully before placing your order. 

OVERVIEW 

This website is operated by Cancer Council Queensland. Throughout the site, the terms “we”, “us” and “our” refer to Cancer Council Queensland. Cancer Council Queensland offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. 

These Terms apply to all users of the site. 

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to offer Daffodil Day pre-order products.

SECTION 1 – ONLINE STORE TERMS 

By agreeing to these Terms, you represent that you are at least 18 years or older. 

You may not use our products for any illegal or unauthorised purpose nor may you violate any laws in your jurisdiction. 

You must not transmit any worms, viruses or destructive code. 

A breach or violation of any of the Terms may result in termination of your access to the Service.  Termination will not affect any rights or obligations accrued prior to termination, including any payment obligations already incurred.

SECTION 2 – GENERAL CONDITIONS 

We reserve the right to refuse or cancel orders where reasonably necessary to comply with law, manage campaign logistics, or protect the integrity of Cancer Council Queensland fundraising activities. You understand that your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted. 

You agree not to reproduce, duplicate, copy, sell or exploit any portion of the Service without express written permission.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION 

We are not responsible if information made available on this site is not accurate, complete or current. 

This site may contain historical information, which is provided for reference only. 

We reserve the right to modify content at any time without obligation to update information.

SECTION 4 – MODIFICATIONS TO THE SERVICE AND PRICES 

Prices for products are subject to change without notice. 

We reserve the right to modify or discontinue the Service at any time. 

We are not liable for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 – PRODUCTS OR SERVICES 

Certain products may be available exclusively online and may have limited quantities. 

We reserve the right to limit quantities or discontinue products at any time. 

Daffodil Day flowers are a fresh, perishable product and may vary in appearance, size and lifespan.

SECTION 6 – PICKUP & FULFILMENT 

All orders placed through the Daffodil Day pre-order store are pickup only.    

Delivery is not available. 

You must select your preferred pickup location and time during checkout. Pickup dates and time windows are set to support campaign logistics and cannot be changed. 

Pickup window means the date and time selected at checkout for collecting your order. 

At pickup, you (or a nominated person) must: 

  • attend the selected location during the nominated pickup window; and  

  • present your order confirmation (digital or printed). 

Uncollected Orders: 
If an order is not collected during the selected pickup window, it may be forfeited. This is due to the timecritical nature of supplier deliveries, the perishable nature of flowers and campaign logistics.  Cancer Council Queensland is unable to store, redistribute or reallocate uncollected orders.

SECTION 7 – ACCURACY OF BILLING AND ACCOUNT INFORMATION 

We reserve the right to refuse or cancel any order. 

You agree to provide current, complete and accurate purchase information for all orders. 

We may contact you using the details provided to confirm or amend your order if required.

SECTION 8 – ORDER CHANGES, RETURNS & REFUNDS 

Requests to modify or cancel orders must be made as soon as possible. 

Due to the nature of Daffodil Day pre-orders (including perishable goods and pre-allocated stock): 

  • Changes or cancellations may not be possible once orders are processed 

  • Refunds are limited and will only be considered in accordance with this section and the Refund Policy below.

SECTION 9 – OPTIONAL TOOLS 

We may provide access to third-party tools “as is” without warranties or conditions. 

Use of these tools is at your own risk.

SECTION 10 – THIRD-PARTY LINKS 

This site may contain links to third-party websites. 

We are not responsible for the content or accuracy of third-party sites.

SECTION 11 – USER COMMENTS, FEEDBACK AND SUBMISSIONS 

If you provide feedback or submissions, you agree that we may use them without restriction. 

You must not submit unlawful, offensive or misleading content.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS 

We reserve the right to correct any errors or inaccuracies and to update or cancel orders if required.

SECTION 13 – PROHIBITED USES 

You may not use the site for unlawful purposes or to violate any laws or rights. 

We reserve the right to terminate access for prohibited use.

SECTION 14 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY 

We do not guarantee that the Service will be uninterrupted or error-free.  Orders are campaignspecific and timecritical Distribution relies on suppliers, volunteers and temporary pickup locations. 

To the extent permitted by law, Cancer Council Queensland is not liable for: 

  • any loss arising from failure to collect an order within the allocated pickup window 

  • reasonable variations in fresh, perishable products such as flowers, including variations in appearance, size or lifespan  

Once goods have been delivered to selected pickup location, responsibility for timely collection rests with the purchaser  Nothing in these Terms excludes your rights under Australian Consumer Law.

SECTION 15 – INDEMNIFICATION 

You are responsible for any loss or damage caused by your breach of these Terms, and you agree to compensate Cancer Council Queensland for any resulting claims or costs.

SECTION 16 – SEVERABILITY 

If any provision is found to be unenforceable, the remaining provisions will remain in effect.

SECTION 17 – TERMINATION 

These Terms remain in effect unless terminated by you or us.

SECTION 18 – ENTIRE AGREEMENT 

These Terms constitute the entire agreement between you and Cancer Council Queensland regarding use of the Service.

These Terms are governed by the laws of Queensland, Australia.

We reserve the right to update these Terms at any time. Continued use of the site constitutes acceptance of any changes.
